Changes in employment conditions must be reported to ISSS before they occur. Sometimes a change only requires documentation for the H-1B employee’s ISSS file. Other times it could require the filing of an amended H-1B petition with USCIS before the change can occur.
A change in employment conditions occurs under the following circumstances: lateral transfer; promotion; change in FTE status; or early termination.
Lateral Transfer
ISSS must be notified in advance and give approval before a lateral transfer may take place.
Email ISSS the proposed transfer information, including name of department transferring from and to, title, and salary. ISSS will respond via email to confirm that the transfer is acceptable and no amendment is needed.
Prepare a letter from the new supervisor to ISSS confirming the transfer. See transfer request letter template.
Fill out the lateral transfer request form under "H-1B Employee Management" in ISSS Link and submit along with a scan of the letter to ISSS.
Promotion
ISSS must be notified in advance and give approval before a promotion may take place.
Prepare a letter from the supervisor to ISSS confirming the promotion. See promotion request letter template.
Complete promotion form under "H-1B Employee Management" in ISSS Link and submit along with a scan of the letter to ISSS.
Change in FTE
ISSS must be notified in advance of change. Amendment will need to be filed with USCIS.
Prepare a letter from the supervisor to ISSS confirming the change in FTE. See change in FTE request template.
Complete change in FTE form under "H-1B Employee Management" in ISSS Link and submit along with a scan of the letter to ISSS.
An amendment will need to be filed with USCIS. Follow instructions under "General Request Process".
Early Termination
Early termination is defined as cessation of employment more than 30 days before end date of H-1B. ISSS should be notified as soon as possible.
Complete the Early Termination Form under "H-1B Employee Management" in ISSS Link and submit to ISSS.
ISSS will contact USCIS to cancel the H-1B petition.
If an amended H-1B petition must be filed, then the department must complete the ISSS on-line request form in ISSS Link according to the general request process.
