The department must request an extension on behalf of a current Emory H-1B employee and should initiate the extension request up to 8 months prior to the end date of the current H-1B approval period. Please follow the general request process.
H-1B temporary workers are limited to 6 years of employment in the U.S. Any single request to sponsor an H-1B temporary worker, however, cannot exceed 3 years. Once the 6 year limit has been reached, an H-1B temporary worker would have to leave and reside outside the U.S. for one year before returning in H-1B status for another six years.
Provisions for extension beyond the 6 year limit: If a labor certification or an I-140 petition (if labor certification is not required) has been filed by an employer (or an employee in the employment-based self-petition preference categories) more than 365 days prior to the H-1B’s six year limit, then the department may request extensions beyond the six year limit.
