The department must request an extension on behalf of a current Emory O-1 employee up to 6 months in advance of the current O-1 approval expiry date. O-1 temporary workers are initially admitted for a period of 3 years. After that, an O-1 can be extended in one year increments. There is no statutory limit on O-1 extensions, however departments should be advised that this is “temporary” work authorization and extensions beyond six years are likely to received increased scrutiny at USCIS and subject to denials.
Each time an extension is filed, departments will need to provide justification for why the position needs a person of extraordinary ability and updated evidence as to the person’s extraordinary ability.
