The EB-2 process begins with a labor certification. A labor certification is a finding by the Department of Labor that:
There are not sufficient U.S. workers in the geographic area of employment who are able, willing, qualified, and available to do the job in question, and
The employment of a foreign national will not adversely affect the wages and working conditions of similarly employed U.S. workers.
Depending on the position the employee will have, the labor certification may follow one of two procedures: Special Handling for College and University Teachers, or Standard Filing. These procedures are detailed under their respective links on the left.
After the labor certification is approved, the form I-140 can be filed with USCIS. (link to I-140 and I-485)
