Changes in employment conditions must be reported to ISSS before they occur. Sometimes a change only requires documentation for the TN employee’s ISSS file. Other times it could require the filing of an amended TN petition with USCIS or travel outside the U.S. and re-entry in TN status based on the new position before the change can occur.
A change in employment conditions occurs under the following circumstances: lateral transfer; promotion; change in FTE status; or early termination.
Lateral Transfer
ISSS must be notified in advance and give approval before a lateral transfer may take place.
Promotion
ISSS must be notified in advance and give approval before a promotion may take place.
Change in FTE
ISSS must be notified in advance of change. A change from full-time to part-time and vice versa constitutes a significant change in employment conditions and either requires the filing of an amendment petition with USCIS or travel outside the U.S. and re-entry in TN status based on the new position before the change can occur.
Early termination is defined as cessation of employment more than 30 days before end date of TN status approved on the I-94 Departure Record Card or I-797 Approval Notice if a petition was filed with USCIS. ISSS should be notified as soon as possible.
Complete the Early Termination Form under "TN Employee Management" in ISSS Link and submit to ISSS.
If an amended TN petition must be filed due to significant changes in employment conditions, then the department must complete the ISSS on-line request form in ISSS Link according to the general request process.
