As of 1 September 2011, Emory departments will be required to pay the $325 filing fee for H-1B petitions for faculty and staff in that status. The $325 fee is the standard application fee assessed by United States Citizenship and Immigration Services (USCIS). Federal regulations require that the fee be paid by the hiring organization, rather than by the employee.
As a reminder, departments also remain responsible for the $500 fraud detection fee assessed by USCIS. This fee, in addition to the $325 standard filing fee, must be paid by separate check to the “Department of Homeland Security.” For those wishing to file petitions via the premium processing procedure, the $1225 should be paid by the department if the application is being processed for business necessity. In other words, if the petition must be filed with a premium processing fee to expedite the processing of the petition to onboard or retain an employee, then the premium processing fee should be paid by the department. To expedite the processing of a petition to facilitate the renewal of a foreign national’s driver’s license or to facilitate personal travel abroad is not considered a business necessity. Emory's new H-1B fee payment policy will take effect on 1 September 2011. Any petition received on or after 1 September 2011 will require a departmental check issued for $325.00 for the standard filing fee. The $500.00 fraud detection fee is only required for the initial H-1B filing to onboard a foreign national in H-1B status at Emory University. This fraud detection fee is not required for H-1B extension or amendment filings.
