USCIS Has Reached Fiscal Year 2012 H-1B Cap

U.S. Citizenship and Immigration Services announced on Nov. 23 that it had received a sufficient number of H-1B petitions to reach the statutory cap of 65,000 for fiscal year 2012 (FY12). The final receipt date for new petitions requesting a start date during FY12 (i.e. any date between Oct. 1, 2011 and Sept. 30, 2012) was Nov. 22, 2011. More than 20,000 petitions were received for the pool of visas reserved each year for individuals with a master’s degree or higher earned from a U.S. institution.

USCIS will begin accepting additional cap-subject H-1B petitions on April 1, 2012 for FY13 (Oct. 1, 2012 through Sept. 30, 2013).

**PLEASE NOTE: Educational institutions (including Emory University) are exempt from the limitations of the H-1B cap when filing petitions on behalf of their employees.**
