Early termination is defined as cessation of employment more than 30 days before the end date of approved TN employment. Emory University has a legal obligation to notify USCIS (U.S. Citizenship and Immigration Services) as soon as an employee is terminated if that termination occurs more than 30 days prior to the end date on the TN approval notice AND Emory University filed a petition to authorize that employment. If you however simply processed into the U.S. in TN status without have a petition filed, you have a legal obligation to voluntarily depart the U.S. immediately. Your department must contact ISSS in writing as soon as it has made a determination that your employment will be terminated:
The department must fill out the Early Termination Notification and send it to ISSS.
ISSS will contact USCIS to cancel the remaining period of the approved TN petition if such petition was filed to USCIS by Emory.
